What a douchebag.

This is quite disturbing... it's really awful to see see how roy turns this into Smash being an ass, because he had copyright problems and account banned on youtube before!?...

What a pure full display of double standards and hypocrisy.

Smash is mean. :(

Although on the other hand, this roy bloke is obviously a blogger, and there's nothing a blogger likes more than something new to blog about. This is probably the most excitement he's had in years. And not even bloggers give a shit about other people's blogs anyway, so whatever, right?

Oh man, If I were the one who used your content in a production for some kind of remix or something and you guys were angry about it - i would just say - "sorry guys - i just really like what you are doing. im sorry." - I will ask you before the next time. I would pay for a round - and that would be it - wouldnt it ? - simple.
So, did Smash get his money in the end?

okkie: its not about the money (and i dont think there is any anyway), its the principle!

Hey Everybody,

Thanks to SRC (or whatever his real handle/name might be) from Mercury who provided me with the link to this Pouet thread at my blog.

Okay, for almost everybody in this thread a little something in response. Only take as much offence as I did and we will be fine :).

Smash was right, yes, I have a pouet.net account, since 2007, although I had a scene.org account for many more years already.

Keito: I am not associated with Affiliate Summit. I also did not pay for a pass, because I got a press pass, which is free. I also was nominated for an award by them, so I guess they had to let me in for free then.

"Who would hire him when he steals stuff like this? :)"
The stuff where you have the problem with wasn't part of the content, not even related, nor necessary.

"how can it be that one guy can bring him self into this big trouble?!"
Shoot me, no better, send me to a labor camp and work me to death... at least crucify, if the KZ is not an option.

"What a pure full display of double standards and hypocrisy."
You obviously did not read the posts, or you wouldn't have said that.

"So, did Smash get his money in the end?"
You mean all the money that I made with my content and the intro that has a snippet of the video recording of his demo in it? He can have it, if he can find a bank that accepts a check over $0.00 to deposit. If I add my time that I spent to it, the balance would be negative and I don't think that Smash would like to get that.

"Roy vs. The Demoscene"
.. That would be the day. I spent a lot of time promoting the demo scene.. Oh, did you see my YouTube channel http://www.YouTube.com/SACReleases btw? ... And did you check my web site at http://www.roysac.com/ ? ... No further comments

"he should've just answered his email"
I found the note by smaash (that's the name he used, just FYI Matt). It was sent on Monday morning 1. June 2009, 1:22am (PST), on Tue, Jun 2, 2009 at 9:31 AM I got already the email from YouTube about the take-down. Not much time to respond, or was there? That holds true, even under normal circumstances, which I wouldn’t say apply for me at the moment, but that is my own problem and none of your business, really.

"i know shit about affiliate marketing an such, but i'm pretty sure they're amongst people who're guilty for this whole economic crisis. :D so are you! :)"
- sure, I also caused 9/11, Katrina, the Kobe earthquake, dropped the nuke over Hiroshima, killed millions of Jews in the German death camps.. Whatever you say. :)

"Although on the other hand, this roy bloke is obviously a blogger, and there's nothing a blogger likes more than something new to blog about."
You guys are fascinating, you seem to know everything and all it takes is taking a look for 1 or 2 minutes tops and you got the full picture, understood everything and knew how to deal with it as well. Marvelous.

"However, I would appreciate, if you would give credits where credits are due. A link to this site, a "thank you" email, a donation or anything else to show your gratetude would be appreciated as well."
yeah, likewise mate!"
- The difference is that I won't take legal action within a bit over 24 hours against somebody who didn't do it. Actually, not even after a week or more, since I made it clear that my content is available for free use, re-purpose, remix, whatever, as long as the results (or the part where my stuff is used) is not copyright protected material (that's what the "Free Art License (FAL) 1.3 (Copy left Attitude))." (http://artlibre.org/licence/lal/en/) boils down to. P.s. Thanks btw. Because of quoting my text 100%, you also did quote my spelling error, its gratitude and not "gratetude". I already fixed that on my site now :)

smash: what's "cheeky" about the "about" section of my site at Cumbrowski.com?

""Hilton New York", I am fairly sure money is involved and most likely amazingly extreme amounts of it."
... It says Hilton, so I guess it MUST be a lot of money involved, 100 Billion dollars at least. Prejudges is a bitch.

"CUM BROW (ski)"
hey, you stole my own joke. I am sure that I can find it somewhere where I published it publically. I sure did non-public, even worse, you must have stolen it, hacked into the system. Let me dig that up and send a lawyer after you... on a second thought, no, because that wouldn't be me. Last time I checked, I wasn't considered to be an Asshole and I would like to keep it that way.

"heh, of course only comments approved by him are shown in that blog. :)"
Let me know how to configure Blogger to accept comments from ANYBODY (including anonymous), but only auto-approve the comments by a user with a Blogger, Google or OpenID account. That would help for starters, I didn't even ask for keyword checks and other spam rules. Well, moving the blog to Wordpress is on my "eventually to do list" for a long time. I have approved virtually every comment by people that were clearly not generated by automated spam-bots. I am not hiding and want to hear feedback, even if somebody decides doing it anonymously for whatever reason.

==== End of BS, now to the stuff that really matters =====

Now Smash: I request of you to retract the complaint at YouTube. If you don't, then I will send a mail to YouTube stating that the complaint was only regarding an irrelevant snippet of the videos and not the main content itself. That's not a threat, because I am sure that YouTube gives a damn about it, unless you send a Lawyer after them (that's not an assumption btw). I stated the reasons for this step in my blog post.

I hope you saw that I did provided credits, where the intro snippet itself was up for discussion. I don't mind to add to the end of the video a text that the intro snippet is based on a few seconds segment of a demo of whose creation you were part of. Code & Gfx: Smash/FLT, Gfx: Navis/ASD, Music: Keito/Alcatraz (Hey Keito, the music rocked btw).

Also, if you don't want me to use your stuff at all, let me know. I would be a bit surprised though, because I believe that recognition is the main driving factor why we do what we do.

How does this sound to you? Is it something you can agree on? Let me know. I sent you my direct email via LinkedIn. It's also listed on the COntact page at Cumbrowski.com, which you obviously found already. :)

I should say something about all this, but I'm too tired and I agree with "what smash says".

Don't just agree blindly with everything Smash is saying. Hey I am an huge admirer of ADS.. and that's no slime, I can proof it :)

See this, this here too and also this.. hehe.

You might also notice something there ... well you are all so bright that you should figure it out in a split-second, right?! (That was not addressed to Navis btw., the people who I addressed this to should know that I mean them).

"Also, "who posted what" FAIL."

What do you mean by that?

I usually do not use the Pouet message board for this kind of stuff.

I only used it for general comments to productions and to post invalid or missing resources to the fix me beautiful thread.

If i did something incorrectly (except from the content itself, which you might not like and/or disagree on), please let me know. Thanks.

roy: nice misquoting, you attributed a load to me which werent by me. good job!
seeing as you seem to be utterly incapable of reading emails to your "official address" (which i already mailed this morning - shame you didnt read it before shouting off here), replies to your blog post (which i did yesterday morning) and so on, i'll post the edited highlights here and see if you read them this time. im utterly bored of this issue now.

1. when i first found out that you (not knowing you were a scener at this point) had stolen some of our demo, i contacted you via your "contact" page on your website. i got a response saying it was delivered. so, i assume you read it. at that point i assumed you were just a random youtube lamer, so i said along the lines of "explain yourself and remove the content".
you didnt respond.
i dont know why i bothered finding you and contacting you at all, actually. thats more effort than i should have taken. that's clearly more work than you put into finding who made the video you ripped off so you could contact them and ask nicely.

2. i got bored of waiting after 2 days (my time), and assumed you werent going to respond, so i filled in the short form on youtube to get it removed. thinking to myself at the time that i should have just done that in the first place - why did i even bother giving the guy a chance to explain?

3. i discovered you were a scener - thanks to someone on here pointing it out. that just irritated me even more, because a scener should a) know where to find the authors and so on to ask them if they could use the stuff, and b) should know a lot better than to rip it off in the first place.

4. you woke up and started complaining loudly on your blog, pouet and other sources about how incredibly unfair it is that someone would dare post a copyright violation notice about any of "your" work.
you managed some classic quotes like "Team Mates or Hates?" and bitching about sony, and demanding that i remove the copyright violation notice.

So, let me explain where you went wrong.
1. you ripped off someone elses work without credits, and claiming it was yours (i quote: "beta of my new intro"). you say "a few seconds - 15s and 45s" - 45 seconds is 25% of the demo.
2. you fucked up said work by adding some horrible text, destroying the encoding (oh wait, you called that "effects" i think) and breaking the aspect ratio.
3. you never attempted to ask permission or contact the authors at all - even claiming you didnt know who to credit. thats funny because you know where pouet is, you know where to find the demo, and presumably knew to read the info file linked on pouet for your convenience, which had the names and full emails of everyone involved. the irony being you used to make ascii/ansi for info files, so you should be familiar with the concept.
4. when caught out, doing the decent thing and apologising and removing the content didnt enter your head. instead you made things worse by getting defensive and kicking off about it - blaming ME for not contacting you about the issue and so on.
you managed to make things worse by posting irate blog posts dissing me, by thumbing the demo down on pouet (hey, it was good enough for you to rip off - show a little respect, no?) and so on. you started saying how un"scenelike" it all was - well, all this ripping and so on is as un-scenelike as you can get. in my mind a scener wouldnt act like that.

to summarise: from my point of view, you ripped us off, you didnt respond to contact asking to explain yourself - a step we needn't bother have taken, and im sure many others wouldnt have. you got incredibly upset when your videos were removed for a (completely accurate) copyright violation, and you got angry at us about it.

if you wanted to clear this up you could have done so in 10 minutes by a) holding your hands up and apologising, and b) removing the material. job done.
(id rather not have the stuff used in this context even with credit,
because the "re-edit" is so rough i wouldnt want my name attached to it.)
sadly i dont think you even think what you did was at all wrong.

so remind me- why should we retract the complaint exactly?

roy: taking that fragment and claiming that it was your makes you an arse. trying to jabber all kinds of bullshit to claim what you did was right makes you a bloody moron. ;P
Roy: congratulations! You actually managed to make it even worse. That´s pretty amazing, and yes, you quoted a lot of people wrong in your above post.

I did read this whole thread, and you entire blog. maybe you just don´t want to accept that I feel that you´re a hypocrit and have severe issues of double standards regarding this issue - too bad, to me it´s the exact opinion I got after reading it all.

Also: exactly what Smash said!

Roy: the reason I said I agree with smash is because I do so in principle. I haven't read much of what was said in the blog or here, but I must say that any other time people have used visuals from an ASD demo they always asked us beforehand.

But ok, it is not the crime of the century, you didn't make any money and that's all fair enough. Needless to say I don't agree with some sort of mistreatment you got in this bbs, but then again it is pouet and we've all have had some over the years.

Smash has done the bulk of the work for this demo, so it is his calling. I have nothing further to add.

oh and you thumbed down the production. Why ? Do you know that for every thumb up we get here at ASD heavy industries gargaj gives us 10 E ?

Do not upload any TV shows, music videos, music concerts or commercials without permission unless they consist entirely of content you created yourself. The Copyright Tips page and the Community Guidelines can help you determine whether your video infringes someone else's copyright.

Just so you know.

I did not claim it to me mine. Anyhow, this way it only gets worse. I will explain to you, if you are willing to skype with me.

Smash, do you have skype? my user is ccumbrowski
I have it currently up running and will keep it up for the next hours so that you can get in touch with me. You responded very quickly here, so I assume that you will get my message here still in time. If not, lets schedule a time to chat,
